To be honest, almost every case in the HK judiciary with appeal history underpins what I have said.
A CFI verdict can be overturned by CA. A CA verdict can be overturned by CFA. As simple as that.
What I mean is the judiciary as a whole has the final power of adjudication which all other parties (including DOJ) must come to terms with.
You may consult this book to know more about the HK Legal System, even though it is a bit outdated.

I still feel a bit uncomfortable that you are comparing the entire DOJ to a magistrate/judge.
It is like comparing an apple to an orange.

DOJ has the power to prosecute. Even though the court might think prosecuting the defendant in question is unnecessary/inappropriate, DOJ still can proceed with the prosecution.
